OpenAI has substantially expanded its EU offering over the past few years, but residency is unevenly distributed across the product catalog – and it covers less than many people think. Here’s what applies in 2026, and the traps that are most expensive to discover late.

The Product Tiers: Who Can Get EU Residency

Residency isn’t a setting you switch on after the fact. It’s a property of certain product tiers, and only for new environments:

The pattern is clear: the consumer and mid tiers lack the residency option entirely. For organizations with GDPR requirements, it’s the Enterprise tenant or the API platform’s Europe region that applies – everything else means processing in the US. At the same time, check which license type you actually have – many organizations believe they have Enterprise but are actually on Business.

What Residency Covers – and What It Doesn’t

On new EU tenants, residency covers data storage, and since January 2026 also GPU inference: the actual model execution then happens within the region. That was an important step – storage without inference is only half a promise.

But everything around it doesn’t automatically come along. Authentication, routing, indexing, and analytics can sit outside the region, and certain endpoints are excluded from residency. “We have EU residency with OpenAI” is therefore too blunt a summary for a DPIA. Verify per endpoint which parts of your flow are covered, and get it in writing for exactly the features you use.

A practical approach is to list every call in the flow – chat, file upload, search, embeddings – and mark, row by row, what the provider has confirmed in writing. The rows without confirmation are your actual risk surface, and the list is also exactly what an auditor wants to see.

The Migration Trap: Nothing Carries Over

The most common miscalculation in practice: existing accounts, projects, and API keys can’t be converted to EU residency. Residency is determined when the environment is created.

An example. A company has run ChatGPT Business since 2024 and built two API integrations against its internal systems. When compliance requires EU residency, upgrading isn’t enough: it takes a new Enterprise tenant, or new EU projects with new API keys. The history doesn’t carry over and stays in the US, and the integrations need to be repointed at the new projects. The right way to handle it is as a migration with its own timeline, test phase, and communication – not as a checkbox on an order form. At the same time, use the move as an opportunity to clean up: it’s the right moment to take stock of which integrations are actually in use and which prompts contain personal data unnecessarily.

The Monitoring Level Is Part of the Package

EU residency on the API platform also requires your organization to be approved for one of two monitoring levels: Modified Abuse Monitoring, where abuse detection happens without your prompts being stored for review, or zero data retention (ZDR), where prompts and responses aren’t stored at all after execution.

Both require approval through OpenAI’s sales organization. Factor the application process into the project timeline, and document the outcome – which level you were granted, for which endpoints, as of which date – in your subprocessor and processing documentation.

Note that the monitoring level affects more than the legal picture: with zero data retention, the provider’s logs disappear as a debugging aid, so your own logging needs to carry the full traceability.

Two more moving parts. The EU region has carried a price premium compared to global operation, and the tiers get adjusted – always calculate against the current price list before deciding. And the widely noted US court ruling that ordered OpenAI to preserve user logs has gained an important carve-out: EEA data has been excluded from the preservation order. The legal situation keeps evolving, though, so make monitoring it a standing agenda item rather than a one-time check.

The summary: OpenAI in the EU is fully possible in 2026, but only on the right product tier, in a new environment, and with per-endpoint verification.
